Agreement to these terms
By creating an account or using Himalaya or Peak, you agree to these Terms of Service. If you're using the service on behalf of an organization, you're agreeing on its behalf and confirming you have the authority to do so.
The service
Himalaya is a deployment platform; Peak is its command-line interface. Both are early-stage — we don't currently offer an uptime SLA, and features may change, be added, or be removed as the product evolves.
Accounts
You sign in with GitHub. You're responsible for all activity under your account and for keeping your access credentials secure. You must be at least 16 years old to use the service, and the information you give us must be accurate.
Acceptable use
You agree not to use the service to:
- Host or distribute illegal content, malware, or anything that infringes someone else's rights
- Abuse shared infrastructure — cryptocurrency mining, denial-of-service activity, spam, or resource abuse unrelated to running your project
- Attempt to bypass resource limits, security controls, or access other users' projects or data without authorization
We may suspend or remove deployments that violate this section.
Your content
You own the code and projects you deploy. By deploying through Himalaya or Peak, you grant us a license to host, run, store, and transmit that content solely to provide the service to you. You're responsible for having the rights to any code, assets, or data you deploy.
Fees
The service is currently free. If we introduce paid plans, separate billing terms will apply and we'll give you notice before any charges begin.
Service availability
The service is provided "as is" and "as available" during this early-stage period. We don't guarantee it will be uninterrupted, secure, or error-free, and we may modify or discontinue features at any time.
Suspension and termination
We may suspend or terminate an account that violates these terms or abuses shared infrastructure, giving notice where practical. You can stop using the service and delete your account at any time.
Disclaimers and limitation of liability
The service is provided without warranties of any kind, express or implied. To the extent permitted by law, 8848 Lab isn't liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount you paid us, if any, in the 12 months before the claim arose.
Governing law
These terms are governed by the laws of Nepal, without regard to conflict of law principles.
Changes to these terms
We'll update the date at the top of this page whenever these terms change. Continuing to use the service after a change means you accept the updated terms.
